Hurley, according to police, then rushed out and shot Troyke with a handgun. Hurley picked up Troyke’s AR-style rifle while he was on the ground, dressed in all black. However, in the ensuing response, police accidentally shot and killed Hurley, who they thought was a second active gunman at the time. The officer who shot Hurley will not face criminal charges, a prosecutor announced Monday.
